Borea Construction (“Borea“, “we“, “our” or “us“) is committed to respecting your privacy. This policy explains how and for what purposes we collect, use, share and store the personal information entrusted to us. This policy generally applies to the personal information we collect, if any, when you interact with us, such as when you visit our website, communicate with us via social media or email, or apply for a job with Borea. It may also apply to personal information we receive from our customers and partners. This policy does not apply to the collection, use and sharing by Borea of the personal information of its employees.

In this policy, « personal information » is generally defined as any information about an individual that, alone or in combination with other information, allows that individual to be identified. This includes information such as your name, your contact information and your date of birth. It may also include other more technical types of information, but only when this information makes it possible to identify you as an individual.

We limit the collection of personal information to what is reasonably necessary to provide you with our services, to respond to any other requests you may make and for the other purposes described below in Section 4. Use of Your Personal Information. Based on the situation, we can collect the following categories of personal information:

  • Your name and contact details, which may include your email address, your personal postal address and your telephone number.
  • Employment-related information, such as information regarding your resume(s), work experience and education, title and compensation history, work schedules and status, licensure and other credentials, work/residence permits, benefits and leave, criminal history, transcripts, performance reports and evaluations, drug and alcohol test results, disciplinary or termination records, if applicable, when you apply for employment with Borea.

3. How We Gather Your Personal Information

We can gather your personal information in different ways, including:

  • Directly from you. We may collect personal information directly from you in certain circumstances, for example if you communicate with us (including via email, social media, etc.), apply for a job with Borea (including on job search websites and/or through a third party), visit our offices, meet with a Borea representative at a conference or a business event, or in the course of your business interactions with Borea.
  • From our clients and our partners. If you are an employee of a Borea customer or partner, your employer may provide us with personal information about you to the extent that is relevant to the business relationship between Borea and your employer.

4. Use of Your Personal Information

We may use your personal information for the following reasons :

  • Providing our services. We use the personal information necessary to provide our services. For example, we may need to use your personal information to manage Borea’s business relationships when carrying out a given project.
  • Communicating with you. If you contact us to ask a question or request information about our services, we may use your personal information to respond to you. We may also contact you for business development purposes and to promote our services and offers.
  • Processing job applications. If you apply for a job with Borea, we may use your personal information to process and evaluate your application.
  • Administration and management of our activities and projects. We use your personal information for a number of purposes in connection with our business and projects, which may include performing due diligence to prevent or reduce our business risk and to ensure the security of our information, system or network, introducing our project team to our customers and partners when required, or to comply with applicable contractual and legal requirements, including health, safety, and drugs and alcohol. We may also use this information for internal analysis purposes in accordance with the law.
  • For other reasons authorized or required by law. For example, we may use the information we collect to protect the security of our information and our website, or to comply with a legal requirement, if applicable.

If necessary, we may also ask for your consent to use your personal information for purposes other than those listed herein.

5. Sharing Your Personal Information

We may share your personal information as follows:

  • With our affiliates. Borea may share your personal information with its parent or affiliated companies for the purposes described in this policy, including to comply with applicable laws, regulations and requirements and to ensure that your information is current, accurate and complete.
  • With our service providers. Borea may transfer your personal information to other organizations and companies providing services (such as providers of data processing, document management, administrative services, server backup and hosting, computer software providers and maintenance, professionals such as accountants or lawyers, and credit or collection agencies). We require that these service providers protect your personal information with appropriate security measures and limit their use of this information to that which is necessary for the performance of the service contract.
  • To relevant third parties in the context of potential or completed business transaction. We may decide to sell or transfer, in whole or in part, our business to a third party, merge with another entity, secure our assets or proceed with any other financing or strategic capital transaction (including insolvency or bankruptcy proceedings), acquisition, restructuring, share sale or other change in control of the business. We may share your personal information when necessary for the purposes of such a transaction provided that we require that appropriate security measures be put in place.
  • With one or many third parties. We may share your personal information with your consent or as permitted or required by law. This may be the case, for example, if Borea is required to disclose or share your personal information to comply with a legal obligation, to enforce other agreements, or to protect the rights, property or safety of Borea, its customers and its partners.

6. Cookies and Similar Technologies

A cookie is a file that may be placed on your browser or computer without your knowledge by a website to allow it to monitor your use of the website or your preferences.

The law allows cookies to be stored on your device only in cases where they are strictly necessary for the operation of this website. For all other types of cookies, we need your consent.

Borea does not currently use cookies or other tracking technologies to monitor your use of this website or your preferences.

While we do not use cookies for tracking purposes as mentioned above, please note that certain third-party services and content embedded within our website may use cookies or other tracking technologies. This includes, but is not limited to, social media plugins, embedded videos, and hyperlinks to other websites. Such third-party services are governed by their own confidentiality and privacy policies and practices, and Borea doesn’t have control over their use of cookies or data collection methods. In no event shall Borea be liable to any user or anyone else in connection with the confidentiality or privacy practices of third parties.

7. Your Privacy Choices

Your consent is required for the collection, use or sharing of your personal information. By accepting this Privacy Policy, you consent to the collection, use and sharing of your personal information as set out herein. We will also obtain your consent when we want to use your personal information for purposes other than those set out in this policy or in the terms and conditions of a specific service you have requested (except when the law provides a clear exception), all in accordance with applicable privacy laws.

Upon written notice given in a reasonable timeframe, you may withdraw your consent to the use and disclosure of your personal information by Borea, subject to any legal or contractual restrictions. For any request regarding your consent, including its withdrawal, please send us a written request via the contact information in Section 14. Language. The withdrawal of your consent may affect the services we can provide to you and your employer.

8. Protection of Your Personal Information

To protect the confidentiality of your personal information, we use administrative, physical and technological safeguards to prevent unauthorized access, use or disclosure, loss or misuse of personal information. We also apply safeguards when we destroy or anonymize your personal information.

9. Retention of Your Personal Information

We retain your personal information for as long as necessary to provide you with our services, to manage our business and to comply with our legal obligations. When it is no longer required, your personal information is securely destroyed or rendered anonymous (so that it is reasonable to assume that this information will no longer allow you to be identified directly or indirectly and irreversibly so).

10. Hosting Personal Information

We are a company whose main place of business is in the province of Quebec. We generally host personal information in Quebec or, when this is not possible, in Canada. However, some of our service providers may access, process or host personal information outside Quebec or Canada, including in the United States. As a result, your personal information may be subject to the laws of foreign jurisdictions, including any laws authorizing or requiring disclosure of the information to the government, government agencies, courts and law enforcement authorities in that jurisdiction. We will only share personal information with a third party outside Quebec or Canada if we are satisfied that it will be adequately protected in the foreign jurisdiction.

11. Access to and Correction of Your Personal Information

Borea respects your right to access your personal information, to request its deletion or its rectification if it is inaccurate or incomplete and to request the transfer of certain personal information to a third party, subject to applicable legal restrictions. 12. Changes to the Privacy Policy

We may change this policy from time to time. Any changes we make come into effect when we publish the revised policy on our website. Should we make major changes to the policy, we will post a notice on our website or contact you to notify you when required by law. By continuing to interact with us after the publication of the modified version of the policy, you accept these changes, subject to any additional requirements that may apply. The “effective date” at the top of this policy indicates the date of its last update.

13. Language

The French version of this Privacy Policy shall prevail in the event of any discrepancy or conflict between it and any other version.
